1 Dean Vierrether, hereinafter referred to as the defendant, was charged by amended information for the offense of Assault and Battery With Intent to Kill, in violation of 21 O.S. 1971 ? 652 [21-652]. He was tried by a jury in the Bryan County District Court, was found guilty, and was sentenced to serve twenty (20) years in the state penitentiary. From said judgment and sentence, the defendant has perfected an appeal to this Court.
