Action to review an award of the Industrial Commission for injuries sustained by defendant Melvin E. Schollmeier while an employee of plaintiffs. From a judgment affirming the order of the Commission, plaintiffs appeal. It is conceded that Schollmeier was an employee, but the contest centers around the question of whether Robert Bachler was an employee of the partners. If he was, they were subject to the Workman's Compensation Act, St.1947, § 102.01 et seq.; if he was not, they had only two employees and were not subject to the Act.
